PersianGig Terms of Service

PersianGig welcomes you. Before you register for your PersianGig account, you must read and agree to the following Terms of Service ("TOS"). Although PersianGig may attempt to notify you when major changes are made, you should visit this page every so often to review the TOS. PersianGig may modify or revise the TOS from time to time and you agree to be bound by such modifications or revisions. Description of Service. PersianGig provides users with access to web resources, including web communication tools, communal content containers, and web storage services (the "Service"). PersianGig may establish general practices and limits concerning use of the Service, including the maximum number of days that uploaded or posted Content will be retained by the Service, the maximum number or size of any files or messages that may be uploaded and sent from or received by an account on the Service, and the maximum number of times and the maximum duration for which you may access the Service in a given period of time. PersianGig disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. PersianGig also reserves the right to modify, suspend or discontinue the Service, temporarily or permanently, with or without notice at any time and without any liability to you or to any third party.

Obligations. Recognizing the global nature of the Internet, you agree to comply with all local, national, international rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws from the country in which you reside and other applicable jurisdiction. You must be at least thirteen years of age to use this Service. You agree to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form and maintain and promptly update the registration data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or specially if your account is transferred to or used by a third party other than the registrar, PersianGig has the right to suspend or terminate your account and refuse any and all current or future use of the Service. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your account. You agree to immediately notify PersianGig of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. PersianGig cannot and will not be liable for any loss or damage arising from your failure to comply with this matter. The Service is made available to you for your personal use only. You understand and agree not to reproduce, duplicate, copy, sell, resell, transfer or exploit for any purposes, any fraction of the Service (including your PersianGig ID), use of the Service, or access to the Service.

Proper Use. You understand that all information, data, software, sound, photographs, video, messages, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not PersianGig, are entirely responsible for all Content that you make available via the Service. You agree to not use the Service to upload, post, email, transmit or otherwise make available: pornographic, obscene, nude, adult, graphically violent, and other inappropriate Content; unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable Content; impersonate any person or entity in any way; Content that you do not have a right to make available under any law; unsolicited or unauthorized advertising, promotional materials, "spam," or any other form of solicitation; any material that contains software viruses, spy ware, horses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the Service or any computer software or hardware or telecommunications equipment or servers or networks connected to the Service;
You acknowledge that PersianGig may or may not pre-screen Content, but that PersianGig shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service.

Indemnification. You agree to indemnify and hold PersianGig and PersianGig's interrelates harmless from any claim or demand made by any third party due to or arising out of Content you make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another. You agree not to access the Service by any means other than through the interface that is provided by PersianGig for use in accessing the Service. You agree that there shall be no third-party beneficiaries to this agreement. You agree not to display or use PersianGig's Marks or Trademarks without PersianGig's prior permission in any manner. You agree not to publicize or broadcast any statements, messages, notices, and announcement, declared in restricted or unrestricted areas or not declared by PersianGig, on behalf of PersianGig or PersianGig's interrelates.

Termination. You agree that PersianGig may, under certain circumstances and without prior notice, immediately terminate your PersianGig account and access to the Service. Cause for such termination shall include, but not be limited to, (a) adult or pornographic related activities by you (b) requests by law enforcement or other government agencies, (c) unexpected technical or security issues or problems, (d) engagement by you in fraudulent or illegal activities, and/or (e) nonpayment of any fees owed by you in connection with the Services, and/or (f) breaches or violations of the TOS. Termination of your PersianGig account includes deletion of your password and all related information, files and Content associated with or inside your account. You agree that PersianGig shall not be liable to you or any third party for any termination of your account or access to the Service.

Advertisement. You understand and agree that the Service may include advertisements and you will not be able to opt out of receiving them. You agree not to remove, replace, or anyhow modify advertisement content. PersianGig absolutely protects and under no circumstances would make available the personal information of its users for advertisers. However, for advertisement reports and statistics purposes, some network traffic may be tracked and saved by PersianGig. You understand and agree that these advertisements are necessary for PersianGig to provide the Service.

Intellectual Property Rights. PersianGig respects the intellectual property of others, and we ask our users to do the same. PersianGig does not claim ownership of Content you submit or make available for inclusion on the Service. PersianGig may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement please provide PersianGig's Support Team with an electronic signature, address, telephone number, and email address of you as the owner of the copyright, a description and exact address of the copyrighted work that you claim has been infringed on the site, and a statement by you that you have a good faith belief that the disputed use is not authorized by you as the copyright owner.
